ASSOCIACIÓN EXPERIENTIA, hereinafter “Experientia”, welcomes you to the Experientia Website (the “Website”). 1.- PURPOSE

Experientia, as the responsible party of the Website, makes this document available to users, which regulates the use of www.asociacionexperientia.org, in order to comply with the obligations set out in Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE or LSSI), as well as to inform all users of the website about its terms of use.

Through the website, Experientia provides users with access to and use of different services and content about the Association and its activities made available through the Website. Access to and use of some services may require prior registration as a member of the Website.

Anyone who accesses this website assumes the role of user (hereinafter the “user”), and implies full and unconditional acceptance of all provisions included in this legal notice, as well as any other applicable legal provisions.

As users, you must carefully read this Legal Notice each time you access the website, as it may be modified. The provider reserves the right to modify any information that may appear on the website, without any obligation to notify users in advance, being sufficient its publication on the website.

2.- CONDITIONS OF ACCESS AND USE OF THE WEBSITE

2.1. Free access and use of the website

Access and use of the public part of the Website is free for all users, not requiring prior subscription or registration for viewing. However, the provision of certain services by the Association may require User registration under the terms described below, and prior acceptance of specific conditions that develop and complement this Legal Notice.

2.2. User registration

In general, the provision of Services does not require prior subscription or registration by Users. However, Experientia conditions the use of some services on prior User registration. This registration will be carried out as expressly indicated in the relevant service section.

2.3. Accuracy of information

All information provided by the User must be truthful. For these purposes, the User guarantees the authenticity of the data communicated through service subscription forms. The User is responsible for keeping all information provided to Experientia permanently updated so that it reflects their real situation at all times. In any case, the User shall be solely responsible for any false or inaccurate statements made and for any damages caused to the provider or third parties.

2.4. Minors

For the use of services, minors must always obtain prior consent from parents, guardians or legal representatives, who are ultimately responsible for all actions carried out by minors under their care. Responsibility for determining specific content accessed by minors lies with them. Therefore, if minors access inappropriate content on the Internet, mechanisms such as software, filters and blocking tools should be established on their devices, which, although not infallible, are especially useful for controlling and restricting materials they can access.

2.5. Obligation to make proper use of the website

The User agrees to use the Website in accordance with the Law and this Legal Notice, as well as morality and good customs. To this end, the User shall refrain from using the site for unlawful or prohibited purposes, or in any way that may damage, disable, overload, deteriorate or impede the normal use of computer equipment, documents, files and any type of content stored on any computer system of the provider.

3.- DISCLAIMER OF WARRANTIES AND LIABILITY

Experientia is exempt from any liability derived from information published on our website, provided that such information has been manipulated or introduced by an unrelated third party.

This website has been reviewed and tested to ensure proper functioning. In principle, correct operation is guaranteed 365 days a year, 24 hours a day. However, Experientia does not rule out the possibility of programming errors, force majeure events, natural disasters, strikes, or similar circumstances that make access to the website impossible.

Experientia does not grant any guarantee and shall not be liable, under any circumstances, for damages of any kind that may arise from the lack of availability, maintenance and effective functioning of the website or its services and content; the existence of viruses or malicious programs; unlawful, negligent, fraudulent or contrary use of this Legal Notice and conditions of use; or the lack of legality, quality, reliability, usefulness and availability of services provided by third parties and made available to users on the website.

The provider shall not be liable under any circumstances for damages arising from the illegal or improper use of this website.

4.- COOKIES

The provider’s website may use cookies (small information files sent by the server to the computer of those accessing the page) to carry out certain functions considered essential for the proper operation and display of the site. From the website it is possible to be redirected to content from third-party websites. Since Experientia cannot always control content introduced by third parties, it assumes no responsibility for such content. In any case, the provider states that it will immediately remove any content that may contravene national or international law, morality or public order, and will immediately remove the redirection to these websites, notifying the competent authorities of the content in question.

Experientia is not responsible for information and content stored, including but not limited to forums, chats, blogs, comments, social networks or any other means that allow third parties to publish content independently of the Association’s website. However, in compliance with Articles 11 and 16 of the LSSICE, Experientia makes itself available to all users, authorities and security forces, actively collaborating in the removal or, where necessary, blocking of any content that may affect or contravene national or international law, third-party rights or morality and public order. If the user believes that any content may fall into this category, they are requested to notify the website administrator immediately.

6.- PERSONAL DATA PROTECTION

The provider is deeply committed to compliance with personal data protection regulations and guarantees full compliance with the obligations set out, as well as the implementation of security measures in accordance with the European Data Protection Regulation and Spanish data protection law. All recognizable photographs of patients or users have been published with their consent or that of their guardians.

7.- INTELLECTUAL AND INDUSTRIAL PROPERTY

The website, including but not limited to programming, editing, compilation and other necessary elements for its operation, designs, logos, text, photographs and/or graphics are the property of Experientia or, where appropriate, it has the license or express authorization from the authors. All content on the website is duly protected by intellectual and industrial property regulations.

Regardless of the purpose for which they were intended, total or partial reproduction, use, distribution and public communication require prior written authorization from the provider. Any unauthorized use will be considered a serious infringement of intellectual or industrial property rights.

Designs, logos, texts and/or graphics belonging to third parties that may appear on the website belong to their respective owners, who are responsible for any possible dispute. In any case, the provider has their express prior authorization.
